Terms of service.

SmartBizz is the product name; the Android app’s Google Play listing and package id still carry its earlier name, SmartDine. Both refer to the same product and the same company, DevMonks.

1. Grant of license

Subject to your compliance with these Terms, DevMonks grants you a non-exclusive, non-transferable, revocable license to install and execute the SmartBizz POS application on the authorized number of physical Android tablets, phones, and workstations registered under your organization's package.

2. Business data ownership & Google Drive storage

You own all sales receipts, menu catalogs, pricing rules, tax configurations, and customer ledger entries generated within your store. On the Offline package, SmartBizz keeps these records on your device. On the Basic, Standard, Premium and Enterprise packages, your business data stays in your own connected Google Drive account via Google Sheets; we do not take your business data, and only limited usage analytics such as bill counts are collected.

DevMonks does not claim any intellectual property rights or ownership over your operational transaction data.

3. Merchant responsibilities for tax & compliance

The restaurant owner is solely responsible for:

• Configuring accurate Goods & Services Tax (GST), Value Added Tax (VAT), service charges, and cess percentages applicable to their jurisdiction.
• Verifying the accuracy of printed customer tax invoices before handing them to guests.
• Complying with local food safety, liquor licensing, labor laws, and commercial hospitality regulations.

4. Payment settlements

SmartBizz does not process payments and is not a payment gateway. It encodes standard NPCI-compliant UPI links (such as upi://pay?pa=...) and renders them as QR codes, and it records the payments your staff confirm.

All funds transfer directly from the customer's bank account to your merchant bank account. DevMonks does not touch, hold or route your money, does not charge intermediary transaction surcharges, and is not liable for customer chargebacks or banking network downtimes. A payment a diner claims in the guest app is recorded as unconfirmed until your counter verifies it against your own bank or UPI app.

5. Offline operation & system clock integrity

SmartBizz is designed so billing can continue on the device during broadband outages. To prevent cashier fraud and maintain sequential invoice auditing, the application requires your physical tablet to maintain a valid network-synchronized system clock. Deliberately rolling back system time to backdate sales triggers tamper safeguards.

6. Subscription tiers & device limits

Your subscription tier determines the maximum number of concurrent physical devices (counter billing tills, kitchen display screens, captain waiter phones) permitted to operate for an outlet. Connecting excess unregistered devices will prompt the till to request authorization in the Master Admin console.

7. Disclaimer of warranties & limitation of liability

The application is provided "AS IS" and "AS AVAILABLE". To the maximum extent permitted by applicable law, DevMonks disclaims all warranties, express or implied. In no event shall DevMonks be liable for any lost profits, business interruption, or indirect damages arising out of hardware failures, printer jams, or third-party telecommunication outages.

8. Termination

You may terminate your subscription at any time. Upon termination, your application access ceases. On Basic and above, your operational data remains in your own Google Drive, where you can export it. On the Offline package, export an encrypted backup from the device before you stop using it.
